Regulation of the Auction

  • Online Contemporary Art Auction will be organized for the benefit of the Bátor Tábor Foundation – Foundation – between 28 May-4 June, 2021 in co-operation with Givergy Ltd., and under the supervision of the Kieselbach Gallery and Auction House.
  • The auction will close on June 4, 2021 Friday with a live streaming starting at CET 7.30pm. The auction is led by Nóra Winkler. The possibility of bidding on artworks ends one by one from 1 to 98.
  • The auction items are available both in an online and a printed catalog, and will be on display both in a virtual tour and an offline exhibition between 30 May-4 June, 2021 at Société Budapest, 1051 Budapest, Sas utca 15. The descriptions and illustrations available on the website only serve as identification of the artworks. It is the responsibility of the Buyer to verify the condition of each artwork against the information available in the catalog before the auction.
  • The Artists assume all responsibilities for authenticity of their own artworks. If the work is not original against the information of the catalog, the Buyer can make complaints within 3 months from the first recognition, but latest within 5 years from the auction, when the specific artwork was purchased.
  • Participation and bidding at the auction is only possible after registration on the online auction platform of Givergy Ltd. By registering the Buyers accept the Auction Conditions.
  • Registration is necessary only once, before you start bidding for the first time. It is possible by name, when all other bidders are aware of your identity, or anonym.
  • The Buyer can bid for a lot by clicking the Bid button and typing the next bid. The current bid will be permanently published on the auction platform for the whole duration of the auction. The Buyers accept full liability for all bids submitted by them. Biddings can be accepted by the system until the given closing time of the auction, extension is not possible. Every time when the Buyer has been outbid, will get notification about it.
  • Bidders may retract a bid until the start of the live closing of the auction, which is 19.30 CET on 4th of June, 2021. In this case please contact Zsófia Varga at zs.varga@batortabor.hu e-mail address.
  • The Buyer offering the highest bid at the closing time of the auction shall acquire the winning title of the artwork. Items cannot be purchased under the starting price.
  • The Foundation cannot take responsibility for the hammer prices of the artworks, it depends in every case on the bidding situation. Bids can be made according to the primary bidding step below:

  • It is strongly forbidden to force a third person to buy a lot for much more money than its market value.
  • The Buyer becomes the owner of an item, once all conditions of payment have been fulfilled and the artwork has been collected from the storage of the Foundation.
  • Conditions of payment for the artworks are the following:
    • Artists are entitled to 40% of the hammer price of each item. This payment is to be completed by the Buyer in return of an invoice or contract directly to the Artist’s account. Contracts are provided right after the auction, invoices are provided later on by the Artists themselves.
    • The rest of the hammer price serves as a donation to the Foundation. The donation agreements are provided to the Buyers after the auction. The Foundation may provide a tax certificate on the donated amount in that case, if the Buyer is a registered company.
    • The share of the hammer price between the Artists and the Foundation may vary in some cases, the Buyers will be informed accordingly.
  •  Payment: the Foundation informs the Buyers by e-mail within 10 days after the auction including the relevant bank account numbers and the amounts to be paid. The payment has to be completed within 7 working days after the receipt of the email.
  • After completion of the payment the purchased artworks can be collected from the storage of the Foundation (1135 Budapest, Reitter Ferenc street 50.) within 30 days after the auction. If the buyer fails to ship the item purchased, then the Foundation has the right to charge 5% of the hammer price as storage fee after 40 days from the auction.
  • If the payment is not completed in 30 days after the auction, the Artist will get back his/her artwork unsold.
  • The insurance of the artworks expires on 30 June, 2021, and the Foundation can’t take responsibility for any damages to the artworks after that time.
  • The prices in EURO written in the printed catalog take only informative role, the payment has to be completed according to the actual daily exchange rate of the Hungarian National Bank.
  • In case of questions, which are not settled in this agreement, the paragraphs of Civil Code are the standards.
